What is mediation?

A brief Introduction


Mediation is “the intervention into a dispute or negotiation by an impartial and neutral third party (with no decision-making power) to assist disputing parties in voluntarily reaching their own mutually acceptable settlement of the issues in dispute". Mediation can be used in a wide range of disagreements between individuals, neighbours, family members, employees, business partners, divorcing parties and landlords and tenants. Mediation has many advantages. It is much cheaper than litigation and allows the parties to have control over their dispute. Unlike litigation, the details of which enter the public domain, mediation is a confidential process. Mediation can also help preserve the relationship between the parties by finding a settlement which is agreeable to both sides. The main disadvantage is that reaching a settlement is not guaranteed.
